These Terms & Conditions explain how my website and services work, what you can expect from me, and what I ask of you in return. I’ve written them as clearly and kindly as possible, but they are still legally binding.
By using emswerld.com or booking one of my services, you agree to these Terms & Conditions.

I operate emswerld.com as an independent creative and wellbeing service.
The website contains a gallery of my artwork and information about services that I offer online.
If you are a consumer, nothing in these Terms & Conditions is intended to remove or restrict any legal rights that you have under UK law.
2. My services
I offer online sessions by video call, which may include:
Reiki sessions
Tarot readings
Guided meditation flows
The exact nature, length, price and availability of a session will be explained on the relevant booking or service page at the time you book.
I reserve the right to update, change or discontinue a service where reasonably necessary. If I need to cancel a service you have already paid for and cannot offer a suitable alternative, you will be entitled to a full.
3. Reiki, tarot and meditation — important information
My sessions are offered as spiritual, reflective, creative and/or wellbeing experiences.
They are not medical, psychological, psychiatric, therapeutic, financial, legal or other professional advice.
Reiki
Reiki is offered as a spiritual and wellbeing practice. It is not a substitute for medical treatment, diagnosis or professional healthcare.
I do not claim that Reiki can diagnose, prevent, treat or cure any medical condition.
If you have a medical condition or concerns about your physical or mental health, please seek advice from an appropriately qualified healthcare professional.
Tarot readings
Tarot readings are provided for entertainment, reflection and personal insight.
Tarot readings are not guarantees or predictions of what will happen in the future, and should not be relied upon as professional advice or as the sole basis for important decisions.
I cannot guarantee any particular outcome from a tarot reading.
Meditation
Meditation flows are intended to provide a relaxing and reflective experience.
Meditation can affect people differently. If you feel uncomfortable, distressed, dizzy, unwell or otherwise unsafe during a session, you should stop participating immediately and let me know.
You are responsible for deciding whether participation is appropriate for you.
4. Your responsibility for your own wellbeing
You participate in any Reiki, tarot or meditation session voluntarily.
Before taking part, please make sure that you are somewhere safe and suitable for the session and that you are physically and mentally able to participate.
You should not participate in a meditation or wellbeing exercise while driving, operating machinery, bathing, swimming, or doing anything else where becoming distracted, relaxed or less alert could put you or somebody else at risk.
If you have any concerns about whether a session is suitable for you, please speak to an appropriately qualified healthcare professional before booking.
Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited under UK law.
In particular, nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that the law does not allow me to exclude or limit.
Subject to those legal limitations, I am not responsible for loss, damage, injury or other consequences arising from your voluntary participation in a session where I have acted lawfully and with reasonable care and skill.
5. No guaranteed results
Every person and every experience is different.
I cannot promise that a Reiki session, tarot reading or meditation flow will produce a particular emotional, spiritual, physical or practical result.
You acknowledge that you are responsible for your own choices, actions and decisions following a session.
Nothing said during a tarot reading, Reiki session or meditation should be treated as a guarantee about your future or circumstances.
6. Booking and payment
A booking is only confirmed once I have accepted your booking and, where applicable, received payment.
Prices will be displayed on the relevant service or booking page.
Unless otherwise stated, prices shown to consumers will include any VAT that I am legally required to charge.
You are responsible for providing accurate information when booking, including your name and contact details.
Please do not provide unnecessary sensitive personal information through a booking or contact form.
7. Online video calls and technology
My services are provided online using video-call technology.
You are responsible for having:
a suitable device;
a reasonably reliable internet connection;
access to the relevant video-call platform, where required; and
a quiet and appropriate environment in which to take part.
I will do my best to make your session run smoothly, but I cannot guarantee that internet connections, devices, software, video platforms or other third-party technology will always work without interruption.
If a technical problem prevents a session from taking place, I will work with you reasonably to rearrange the session or provide any refund that is legally due.
8. Arriving late
Please be ready for your session at the agreed time.
If you arrive late, the session may still need to finish at the originally agreed time so that it does not unfairly affect later appointments.
Where a significant delay is caused by me, I will do my best to make the situation right, which may include rearranging the session.
9. Cancellations and your legal right to cancel
If you are a consumer booking a service online, you may generally have a 14-day statutory cancellation period under the Consumer Contracts Regulations 2013.
This is separate from any additional cancellation policy I may offer.
If your session is more than 14 days away
You may cancel your booking during the applicable cancellation period in accordance with your statutory rights.
If you want your session to take place within the 14-day cancellation period
If you ask me to provide the service before the 14-day cancellation period has ended, I will ask you to expressly request that the service begins during that period.
If you then cancel after the service has begun, I may be entitled to retain a proportionate amount for the service already supplied, as permitted by law.
Where a service has been fully performed during the cancellation period after you have expressly requested this and acknowledged the relevant consequences, your statutory cancellation right may end once the service has been fully performed.
I will provide the information necessary for you to exercise your cancellation rights and, where legally required, a model cancellation form.
Nothing in these Terms & Conditions is intended to take away a cancellation right that you legally have.
10. My cancellation rights
Occasionally, I may need to cancel or rearrange a session because of illness, an emergency, technical problems or circumstances outside my reasonable control.
If I need to cancel, I will contact you as soon as reasonably possible.
Where I cannot provide the service and you do not wish to rearrange it, I will provide any refund that is legally due.
I will not use my right to cancel unfairly or simply to avoid my responsibilities to you.
11. Respectful behaviour
I want emswerld to be a kind, welcoming and respectful space.
Abusive, threatening, discriminatory, intimidating, harassing, sexually inappropriate or otherwise unacceptable behaviour is prohibited.
This applies to communications with me, video calls, booking interactions and use of the website.
I may end a session or refuse a booking where I reasonably believe that continuing would expose me or another person to abusive, threatening, discriminatory, harassing or otherwise unacceptable behaviour.
Where a session is ended because of your serious or abusive behaviour, I am not obliged to continue providing the session.
Any refund will be considered in accordance with the circumstances and your legal rights.
Nothing in this section prevents me from taking appropriate action where necessary to protect myself or others.
12. Age requirements
My services are intended for adults unless a service page specifically says otherwise.
If you are under 18, please do not book a session without appropriate parental or guardian involvement and confirmation that the particular service is suitable.
I reserve the right to refuse a booking where I cannot reasonably establish that the applicable age requirements have been met.
13. Artwork and copyright
All artwork, photographs, illustrations, written material, branding, logos, designs and other original content displayed on emswerld.com belong to Emily Ann Harriss or are used with permission, unless stated otherwise.
My artwork and website content are protected by copyright and other intellectual-property laws.
You may view the website and artwork for your personal, non-commercial enjoyment.
You must not copy, reproduce, modify, distribute, sell, publish, commercially exploit or otherwise use my artwork or website content without my prior written permission, except where you have a legal right to do so.
Please do not use my artwork to train, develop or generate artificial-intelligence systems, datasets or models without my express written permission.
Nothing on this website transfers ownership or intellectual-property rights to you.
If you would like to use an artwork, photograph or other piece of content, please contact me first.
14. Website use
You agree to use emswerld.com lawfully and respectfully.
You must not:
attempt to interfere with the operation or security of the website;
introduce malicious code, viruses or other harmful material;
attempt to gain unauthorised access to the website or its systems;
scrape, copy or systematically collect website content without permission;
use the website for fraudulent or unlawful purposes;
impersonate another person; or
use the website to harass, threaten, abuse or intimidate me or another person.
I reserve the right to restrict or terminate access to the website where reasonably necessary to protect the website, myself, other users or the integrity of the service.
15. Website availability
I aim to keep emswerld.com available and up to date, but I cannot guarantee that the website will always be available, uninterrupted or completely error-free.
I may occasionally need to carry out maintenance, updates or changes.
I will not be responsible for temporary unavailability caused by circumstances outside my reasonable control.

The website may occasionally contain links to third-party websites or services.
These websites are outside my control, and I am not responsible for their content, availability, security, privacy practices or terms.
You should read the terms and privacy information of any third-party website before using it.

When you contact me, book a service or otherwise provide personal information through emswerld.com, I may need to collect and use your personal data.

19. Complaints
I genuinely want you to have a positive experience.
If something has gone wrong, please contact me through the forms on emswerld.com and explain what happened and what you would like me to do to resolve it.
I will consider complaints fairly and respond within a reasonable time.
Nothing in this complaints process prevents you from exercising any legal rights you may have.
20. My legal obligations to you
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
Where I provide services to a consumer, the law requires those services to be provided with reasonable care and skill, amongst other applicable consumer protections.
If any part of these Terms & Conditions conflicts with a mandatory legal right that applies to you, that legal right will take precedence.
21. Events outside my reasonable control
I will not be responsible for a failure or delay in providing a service where this is caused by circumstances outside my reasonable control, such as serious illness, significant technical failure, interruption to communications services, natural disasters, government action or other genuinely unforeseeable circumstances.
I will, however, communicate with you as soon as reasonably practical and take reasonable steps to minimise the disruption.
22. Changes to these Terms & Conditions
I may update these Terms & Conditions from time to time, for example if my services change or the law changes.
The latest version will be published on this website with its effective date.
If you have already entered into a contract with me, changes will not retrospectively remove rights you already have or unfairly change the terms of an existing contract.
23. If part of these Terms is not enforceable
If a court or other competent authority decides that part of these Terms & Conditions is invalid, unlawful or unenforceable, that part will be treated as removed to the extent necessary.
The remaining provisions will continue to apply.
24. No waiver
If I do not immediately enforce a provision of these Terms & Conditions, that does not mean I have permanently waived my right to enforce it later.
25. Governing law
These Terms & Conditions are governed by the law of Scotland, unless applicable consumer-protection law requires otherwise.
If you are a consumer living elsewhere in the UK, you may also have the benefit of mandatory protections available to you under the law that applies to your circumstances.
The courts of Scotland will have jurisdiction to deal with disputes, subject to any mandatory rights you may have as a consumer.
